Referring to my earlier Cheque from LHDN post, I think it would be sort of a public service to educate other bloggers on how to claim back the excessive tax that they have paid to LHDN.
My company auto-deduct my salary to pay income tax monthly, thru the Potongan Cukai Berkala (Timely Tax Deduction), which the company would take some of my salary and pay to LHDN on behalf of me. So, there would be quite a sum yearly, which by the time you need to declare your tax assessment, you can take the amount that you've already paid to cover it. In most cases, the amount deducted is less than the tax amount itself. For my cases, I've been paying in excess for 3 assessment years (2002, 2003 & 2004), where the first year (2002), I was not supposed to be taxed (my taxable income was low - just started working like 6 months). I kept all my tax records, so I know how much LHDN owe me.So here's the steps that you can follow to get your extra-paid tax back (from my experience):
1. Go to the district/state income tax office depending on where you are (i went to Sg Petani income tax office - my files are with them)
2. State your wish to claim back the excessive tax paid
3. You would be given a form to fill in - you'll need to take note of your income tax reference number, and which assessment year you need to claim back (in my case, 2002 & 2003). No need to put in the amount to claim if you don't know - i left it blank to countercheck later
3. Submit the form, and you would be informed to wait for response in 3 months time.
4. If there's no response within 3 months, go to the income tax office again to inquire. In my case, when I went there the 2nd time to check on the status, i was informed that my application had been processed, and the sum (RM615 something) was shown on the screen to me.
5. If you got the letter from LHDN saying that your application is being processed, you can start to be happy. (i got the letter after my 2nd trip to the income tax office)
6. Wait for the cheque to arrive in another mail, which took me like 2 weeks to receive it.
There you go - the steps to get your money back from LHDN
Supposed to be faster now, with the announcement from the PM himself during the last Budget tabling. Am waiting for my 2004 excess tax paid coming into my account - starting assessment year 2004, any excess tax paid would be credited to your bank according to your income tax form

3Ya lor ya lor, I keep my tax record from day 1 I started working. Track every mths deduction. End of d year, fill in ITax form, wait for the J form return. Then sure will know who owes who.
